Please note that the terms and conditions below apply to any and all services provided by a staff member of In Grace Yoga Therapy LLC, including but not limited to in-person and online trauma sensitive, wellness, and/or coaching sessions  (collectively, the “Services”). By scheduling an appointment with In Grace Yoga Therapy LLC you confirm receipt and are in agreement to the terms below. 

Please read these Terms and Conditions, and Privacy Policy before using any of our Services. By accessing, installing, or otherwise using any of the Services, you acknowledge that you have read the following terms and conditions, understand them, and agree to be bound and abide by them, together with any documents they expressly incorporate by reference (collectively, the “Terms”). If you do not agree to all of these Terms, you must not access or use the Services.

You must be at least 18 years of age or older, to use and participate in the Services. By booking an appointment or using the Services, you represent and warrant that you are 18 years of age or older and can enter into legally binding agreements under applicable law. If you do not meet these requirements, you must not access or use the Services.

TERMS 

To receive full benefits of all in person wellness offerings all clients must arrive on time for appointments. A grace period of 10 (ten) minutes will be allowed for appointments. Students that arrive over 10 (ten) minutes late for sessions will be denied service and appointments will be canceled. Payment for the appointment will be forfeited and is unable to be redeemed and/or transferred to another service. All rescheduled appointments or cancellations made less than 24 hours prior to appointment will be charged a fee a LATE RESCHEDULE FEE of $50.00. 

FACILITIES 

In Grace Yoga Therapy provides community programming at various locations in Atlanta, Washington D.C, Virginia, Maryland and New York City. Instruction and Wellness Offerings are also offered digitally via various online platforms. 

MEDICAL CONCERNS & RELEASE OF LIABILITY

Movement & Energy Therapies such as Yoga, Sound Therapy, Reiki and Meditation are not a substitute for medical attention, examination, diagnosis or treatment. Yoga is not recommended and is not safe under certain medical conditions. By booking a session you affirm that a licensed physician has verified my good health and physical condition to participate in such a fitness program. In addition, you will make the instructor aware of any medical conditions or physical limitations before class. If  you are pregnant, become pregnant or  have post-natal or post-surgical, you represent and warrant that you have received your physician’s approval to participate prior to booking an appointment or any of the Services offered by In Grace Yoga LLC.   You also affirm that you alone are responsible to decide whether to practice yoga and Energy Therapy and participation is at your own risk. You hereby agree to irrevocably release and waive any claims that you have now or may have hereafter against In Grace Yoga Therapy and its instructors. 

You also agree to assume full responsibility for any risks, injuries, or damages, known or unknown, which might occur as a result of participating in the Services. You agree to follow all instructions by In Grace Yoga Therapy, LLC so that I may safely participate in the Services. If I experience any pain or discomfort, I will listen to my body, inform and ask for support from an In Grace Yoga Therapy instructor. My failure to do so is my sole responsibility.

LIMITATION ON LIABILITY

IN NO EVENT SHALL WE BE LIABLE TO YOU OR ANY THIRD PARTY FOR CONSEQUENTIAL, INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE OR ENHANCED DAMAGES, LOST PROFITS OR REVENUES OR DIMINUTION IN VALUE, ARISING OUT OF, OR RELATING TO, AND/OR IN CONNECTION WITH ANY BREACH OF THESE TERMS, REGARDLESS OF (A) WHETHER SUCH DAMAGES WERE FORESEEABLE, (B) WHETHER OR NOT WE WERE ADVISED OF THE POSSIBILITY OF SUCH DAMAGES AND (C) THE LEGAL OR EQUITABLE THEORY (CONTRACT, TORT OR OTHERWISE) UPON WHICH THE CLAIM IS BASED. 

OUR SOLE AND ENTIRE MAXIMUM LIABILITY, FOR ANY REASON, AND YOUR SOLE AND EXCLUSIVE REMEDY SHALL BE LIMITED TO THE ACTUAL AMOUNT PAID BY YOU FOR THE PRODUCTS AND SERVICES YOU HAVE ORDERED THROUGH OUR SITE. 

The limitation of liability set forth above shall only apply to the extent permitted by law.

METHOD OF PAYMENT 

In Grace Yoga Therapy accepts cash payments, Visa and MasterCard credit cards and contact less payments including Cash App, Venmo, and Apple Pay. There is a no refund policy on all orders and services provided by In Grace Yoga Therapy LLC. 

Payment plan options are available to clients/students for In Grace Yoga Therapy LLC services. Should clients be unable to settle payments, In Grace Yoga reserves the right to cancel services and/or apply a late payment fee of $50.00 to initial arrangement contract prior to continuing services. 

You represent and warrant that: (i) the credit card information you supply to us is true, correct and complete, (ii) you are duly authorized to use such credit card for the purchase, (iii) charges incurred by you will be honored by your credit card company, and (iv) you will pay charges incurred by you at the posted prices, including shipping and handling charges and all applicable taxes, if any, regardless of the amount quoted on the at the time of your order.

DISPUTE RESOLUTION

For any dispute between you and In Grace Yoga Therapy LLC, arising from the use of these Terms (including disputes arising from or concerning their interpretation, violation, invalidity, non-performance, or termination, and your right to privacy or publicity), you agree to first contact In Grace Yoga Therapy and attempt to resolve the dispute with us informally. In the unlikely event that we have not been able to resolve the dispute informally, In Grace Yoga Therapy may, at its sole discretion, require users located in the United States to submit any disputes to final and binding arbitration in the State of Georgia, under the Rules of Arbitration of the American Arbitration Association, applying Georgia law. Nothing in this section shall prevent either party from seeking injunctive or equitable relief from the courts for matters related to intellectual property rights or unauthorized access to the Website. ALL SUCH USERS AGREE TO WAIVE THE RIGHT TO TRIAL, EXCEPT FOR MATTERS THAT MAY BE BROUGHT IN SMALL CLAIMS COURT. YOU MAY REVIEW THE AAA RULES AT WWW.ADR.ORG.

PERSONAL BELONGINGS & LOST/STOLEN ITEMS 

In Grace Yoga Therapy LLC is not responsible for lost or stolen items during wellness offerings. Please place all personal items including car keys, mats, and wallets in a studio cubby at your own discretion and risk.

WAIVER

No waiver by In Grace Yoga Therapy LLC of any term or condition set forth in these Terms shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition, and any failure of In Grace Yoga Therapy LLC to assert a right or provision under these Terms shall not constitute a waiver of such right or provision.

SEVERABILITY

If any provision of these Term is held by a court or other tribunal of competent jurisdiction to be invalid, illegal or unenforceable for any reason, such provision shall be eliminated or limited to the minimum extent such that the remaining provisions of the Terms will continue in full force and effect.

ENTIRE AGREEMENT

The Terms, and all other policies incorporated herein by reference, constitute the sole and entire agreement between you and In Grace Yoga Therapy LLC,  and supersede all prior and contemporaneous understandings, agreements, representations and warranties, both written and oral, with respect to the sales governed by these Terms. If any future Terms are agreed to, such future Terms shall govern.

Refund Policy

Refunds & Cancellations

We do not provide refunds or cancellations for any product or service for any reason including delay in shipping due to the nature of our product. Refunds may be considered if there is an error in your order which was made by In Grace Yoga Therapy, LLC.

PRODUCT/ SERVICE EXCHANGES

There is a no refund policy on all product and service orders. In the event that a customer is unable to attend schedule sessions, events and/or seminars, the ticket is forfeited and there will not be a refund issued to the customer. If a customer orders an product, please note that there is a no refund policy on all orders. Customer will not be allowed to exchange for another item.

INCORRECT AND/OR MISSING ITEMS:

Should you find that your order is missing an item, PLEASE CONTACT US AT INGRACEYOGATHERAPY@GMAIL.COM WITHIN 5-7 DAYS OF DELIVERY TO GET A REPLACEMENT SENT TO YOU, IF AVAILABLE.  A photo of the incorrect item and a picture of the invoice MUST be sent to the email provided.  If the photo or invoice can not be provided we can not send out the replacement item. When emailing, please put "Incorrect/Missing Item" in the Subject Box. Please be sure to include ORDER NUMBER in the email for reference.

Lost/missing/stolen packages

Packages lost, stolen, missing, or indicated delivered by the United States Post Office can be frustrating as we do understand. Please send us an email that your item was lost/stolen as we will need to document this issue. If the package is shipped out correctly by the In Grace Yoga Therapy and it gets lost or stolen, we as the shipper is not responsible. You will need to file a claim with the United States Post Office online at https://www.usps.com/help/claims.htm. The claim can take up to two weeks. Unfortunately, If they do not accept responsibility, this issue is between you and the carrier.
